DANUBIAN COMPETITIONS – TERMS AND CONDITIONS

1. PROMOTER

Throughout these Terms and Conditions, Danubian Holdings LTD shall be referred to as “Danubian”, “the Promoter”, “we”, “our” or “us”.

2. APPLICATION OF THESE TERMS

These Terms and Conditions apply to every competition promoted through the Danubian Competitions website and associated platforms.

By entering a competition, whether through a paid entry or a free postal entry route, you agree to be legally bound by these Terms.

Should any conflict arise between these Terms and any advertising material, social media content, promotional graphics or website content, these Terms shall take precedence.

3. ELIGIBILITY

Participation is restricted to individuals aged 18 years or older.

Employees, directors, contractors, agents and immediate family members of Danubian Holdings LTD may not participate.

The Promoter reserves the right to request proof of:

* Identity
* Age
* Residential address
* Payment ownership

Failure to provide satisfactory evidence may result in disqualification.

Participation is void where prohibited by law.

4. COMPETITION FORMAT

All competitions operated by Danubian are intended to be skill-based prize competitions.

Before completing an entry, participants may be required to correctly answer a question, solve a puzzle, or complete another task designed to demonstrate skill, knowledge or judgement.

Only entries meeting the applicable qualification requirements shall be eligible for inclusion in the prize draw.

The Promoter reserves the right to vary or amend competition questions where reasonably necessary.

5. COMPETITION PERIOD

Each competition shall display an opening date and a closing date.

Entries received after the closing date and time will not be accepted.

All times displayed on the Website are based on London, England time.

The Promoter may extend, shorten, suspend or amend a competition where operational, legal or technical circumstances require.

Any changes will be communicated through the Website.

6. PAID ENTRY METHOD

To enter a competition through the paid entry route:

1. Select the desired competition.
2. Submit the required answer where applicable.
3. Select the desired quantity of entries.
4. Complete checkout.
5. Accept these Terms and Conditions.
6. Successfully complete payment.

An entry is only deemed valid once payment has been successfully received and confirmed.

The Promoter accepts no responsibility for failed transactions, interrupted payments or incomplete submissions.

7. FREE POSTAL ENTRY ROUTE

A free entry route is available for all competitions.

Postal entries must be sent to:

Each postal entry must contain:

* Full legal name
* Date of birth
* Full residential address
* Contact telephone number
* Email address
* Competition reference
* Answer to the Competition Question where applicable

Each entry must be posted separately.

Multiple entries submitted in the same envelope may be treated as a single entry.

Hand-delivered entries will not be accepted.

Free entries must arrive before:

* The Competition Closing Date; and
* The allocation of all available entries,

whichever occurs first.

Proof of posting shall not constitute proof of receipt.

Free entries will receive the same chance of winning as paid entries.

8. ENTRY LIMITS

The Promoter may impose:

* A maximum number of total entries;
* A maximum number of entries per participant;
* Purchase restrictions for specific competitions.

Such limits will be displayed on the relevant competition page.

9. WINNER SELECTION

Once a competition closes, all valid entries will be included in a random draw.

Draws may be conducted:

* Live online;
* Through certified random number generators;
* Through software systems selected by the Promoter.

The method used for each draw shall be determined by the Promoter.

Competition draws may be broadcast via social media platforms including Facebook, YouTube, Instagram, TikTok or other platforms.

The Promoter’s decision shall be final.

10. PRIZES

Prize details will be displayed on the relevant competition page.

The Promoter makes reasonable efforts to ensure prize descriptions remain accurate but reserves the right to correct errors.

Where circumstances outside our control require, we may substitute a prize with an alternative prize of equal or greater value.

Prizes:

* Cannot be exchanged by the Winner;
* Cannot be transferred without written approval;
* Are not refundable.

The Promoter may offer a cash alternative entirely at its discretion.

11. VEHICLE PRIZES

Where a prize consists of a motor vehicle:

* A valid MOT certificate will be supplied where legally required.
* Insurance is not included unless expressly stated.
* Vehicle tax is not included unless expressly stated.
* Routine wear and mileage resulting from transport, servicing, storage, photography or promotional use may exist.
* Responsibility transfers to the Winner upon collection or delivery.

Winners must ensure they are legally entitled to drive and insure the vehicle.

For Winners residing outside the United Kingdom, all costs associated with:

* Importation;
* Customs clearance;
* Registration;
* Homologation;
* Local taxes;
* Duties;
* Transportation;

shall be the sole responsibility of the Winner unless expressly stated otherwise.

12. WINNER NOTIFICATION

Winners will normally be contacted using the information provided during registration.

Notification may occur through:

* Email;
* Telephone;
* SMS;
* Website announcements.

The Promoter shall make reasonable efforts to contact Winners.

If a Winner:

* Cannot be contacted;
* Fails to respond;
* Fails verification;
* Refuses the prize;

within 14 days of notification, the Promoter may select an alternative Winner.

13. WINNER VERIFICATION

Prior to releasing a prize, the Promoter may require:

* Government-issued identification;
* Proof of address;
* Age verification;
* Payment verification;
* Any other information reasonably required for fraud prevention.

Failure to complete verification may result in disqualification.

14. PUBLICITY

By accepting a prize, Winners agree that the Promoter may use:

* First name;
* Initial of surname;
* City or country of residence;
* Photographs;
* Video recordings;
* Winner interviews;

for promotional and marketing purposes.

A Winner may request reduced publicity where legally permitted.

15. FRAUD PREVENTION

The Promoter reserves the right to disqualify any participant who:

* Uses false information;
* Attempts to manipulate a competition;
* Uses automated systems;
* Engages in abusive conduct;
* Commits payment fraud;
* Breaches these Terms.

Any entry linked to fraudulent activity may be cancelled without refund.

16. CHARGEBACKS AND PAYMENT REVERSALS

Any entry associated with:

* A chargeback;
* A payment dispute;
* A reversed payment;
* A cancelled transaction;

shall immediately become void.

The Promoter reserves the right to recover losses, fees and costs arising from fraudulent payment activity.

Accounts involved in payment abuse may be permanently suspended.

17. WEBSITE AVAILABILITY

The Promoter does not guarantee uninterrupted availability of the Website.

We shall not be responsible for:

* Technical failures;
* Internet outages;
* Server interruptions;
* Software defects;
* Telecommunications failures.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Promoter shall not be liable for:

* Indirect losses;
* Consequential losses;
* Loss of profit;
* Loss of opportunity;
* Failed entries;
* Delayed entries;
* Technical errors.

Nothing in these Terms excludes liability for death, personal injury, fraud or any liability that cannot legally be excluded.

19. DATA PROTECTION

Personal information supplied during participation shall be processed in accordance with our Privacy Policy and applicable UK data protection legislation.

Information may be used for:

* Competition administration;
* Fraud prevention;
* Regulatory compliance;
* Winner verification.

20. COMPETITION CANCELLATION

The Promoter reserves the right to suspend, amend, postpone or cancel a competition where circumstances outside our reasonable control make such action necessary.

Where appropriate, refunds or account credits may be issued.

21. GENERAL

Failure by the Promoter to enforce any provision of these Terms shall not constitute a waiver of that provision.

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The latest version of these Terms will always be available on the Website.

22. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

All disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By entering any competition, you confirm that you have read, understood and accepted these Terms and Conditions in full.
